Terms of Service

Terms of Service

These terms govern access to the public website and, where relevant, the business software services provided by TAMMESH.

1. Acceptance of Terms

These Terms of Service govern access to the TAMMESH website and any related business software or services provided under contract.

By using the website or engaging with the service, you agree to these terms and any additional written order forms, statements of work, or commercial agreements that apply.

2. Service Scope

TAMMESH provides software and workflow tools for marketplace sellers, including listing support, product analytics, operational dashboards, and reporting.

Unless expressly agreed in writing, the website itself does not grant access to private software environments, implementation services, or technical integrations.

3. Customer Responsibilities

Customers remain responsible for the legality, accuracy, and authorization of the data, credentials, and business instructions they provide.

Customers must ensure that their personnel use the service for legitimate business purposes and maintain appropriate access discipline.

4. Third-Party Platforms

Where the service interacts with third-party platforms, such use is subject to the relevant platform terms, permissions, and technical requirements.

Nothing in these terms authorizes misuse of third-party systems, circumvention of restrictions, or access beyond approved scope.

5. Intellectual Property

TAMMESH retains all rights in the website, software, documentation, branding, and related materials except where rights are expressly granted in writing.

Customers retain rights in their own data and business materials, subject to any limited licenses needed for service delivery.

6. Confidentiality

Each party must protect confidential information using reasonable care and may use such information only for the purposes of the business relationship.

Confidentiality obligations do not apply to information that is publicly available without breach, independently developed, or lawfully obtained from another source.

7. Service Standard and Disclaimers

TAMMESH will provide the service using reasonable care and professional attention appropriate to a business software provider.

Except as expressly stated in contract, the website and service are provided on an "as available" basis and no specific commercial outcome is guaranteed.

8. Limitation of Liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, or consequential damages arising from use of the website or service.

Any direct liability is limited to the fees paid for the relevant service period unless a different limit is agreed in writing.

9. Termination

Either party may terminate website access or service use in accordance with the applicable contract, or immediately where use presents a security, legal, or policy risk.

Upon termination, rights of access end except where continued retention is required for legal, accounting, or security reasons.

10. Governing Law

Unless otherwise agreed in writing, these terms are governed by the laws of the People's Republic of China, without regard to conflict of law principles.
